Still, our North Carolina State Legislators need to correct other loopholes in state laws towards sex offensives, in order to help make Jessica’s Law work. Jessica’s Law Now will continually help victimized children and fight for laws that will make it harder on sex offenders.
Since 2005, we have assisted with over two hundred cases where a victimized child needed help. Too many times deals are made through plea bargaining and it is the victims’ and their families who suffer. We are just fooling our selves if we do not have strict laws and procedures in place, when it comes to sex offenders.
Jessica’s Law Now is concern about lack of procedures for victims and family members. We are especially concerned about the lack of medical and psychological help, which victims and family members need.
We are concern that a medical exam is not required after sexual assault upon a child. This is crucial, so evidence can be obtained. North Carolina does not have any state law requiring this. We found that it is up to local police departments make this a policy. It seems that many states follow the same thinking. The assaults upon a women and animal have better state and federal laws (with requirements) than our children have. This lack of procedure has put a kinkier into many sexual assault cases. With a child that has autism, the damage is more psychological, since the coping skills are not developed; the child has more of a tendency to act out. This situation can cause more of a strain for the family unit. Help us, help families and stop this cycle of abuse.
Many people requesting Jessica’s Law Now to support castration for sex offenders have contacted us. Why one can understand many reasons given for castration upon a sex offender, we found will not stop the problem. Castration is the removal of the Male testicles, which is the male sex hormone.
The male will not be able to perform sexually but will still have the desires too. In time, male desires can fade but various medications can reverse this. These medications can cause a change in his blood that will help bring back full sexual desires. In time, male can have a full erection and orgasm again.
People that are sexual offenders of children have the wants and desirers toward a child.
Jessica’s Law Now feels that harsher laws and strict sentences is the answer for sex offenders. If the law is not present, then a sex offender receives a lighter sentence and is able to enact again.

Parents, who have suffered the pain, anguish of losing a child deals with this torment constantly. One such parent that suffered this horrible anguish was Mark Lunsford. His daughter, Jessica Lunsford the 9-year-old girl been sexually abused, kidnapped, and buried alive in Florida. This could have been your daughter, just imagine the anguish any parent would have to live with, if this happened to them. John Couey, who convicted, had a record as a sex offender. Once John Couey was not required to wear GPS tracking went for his next victim, Jessica Lunsford.
There are many John Couey types and one could be living next to you?
Jessica Lunsford came from Gaston County, North Carolina before moving to Florida. In the loving memory of Mark Lunsford’s daughter Jessica, a law introduced to enforce stricter laws pertaining to sex offenders called Jessica’s Law. The Jessica Lunsford Act aka. Jessica’s Law:
1.) Increase the penalty for lewd and lascivious molestation of a child to life in prison or a split sentence of a mandatory minimum 25-year prison term, followed by lifetime supervision with electronic monitoring.
2.) Increase, from 20 to 30 years, the period before a sexual predator is allowed to petition to have the sexual predator designation removed.
3.) Increase sexual predator/offender registration and reporting requirements.
4.) Sexual predators who murder their victims now qualify for the death penalty in capital cases.
5.) Failing to re-register as a sexual offender/predator, harboring, or assisting a sexual predator/offender is a third degree felony.
7.) Require all county misdemeanor probation officials to search the sexual offender registry when a new offender is assigned to them.
On April 16, 2008, Mark Lunsford told Jessica’s Law Now North Carolina, “What happened to my daughter should have never happened, and I'm working to make sure it doesn't happen to another child. It saddens me to know my home state of North Carolina has not yet passed Jessie's Law. I won't rest until we do.”
We need our local and state officials still push for stronger laws against molestation. North Carolina still does not have strong enough punishment for the molestation of minors. Sex offenders are moving specifically into states that have soft laws, such as North Carolina. Jessica’s Law Now wants to change this.
"We should all work together to make sure that Jessica's Law is passed in all fifty states. There are presently 15 states that have not yet passed any form of Jessica's Law, it saddens me to think that my home state of Tennessee and North Carolina where I grew up are included in the list of states that have not passed Jessica's Law. Since Charlie Daniels made this statement in 2007, laws have become stricter in Tennessee for sex offenders. Tennessee now has a version of Jessica's Law. Late 2007, North Carolina is one of several states that had not stepped up to the plate for Jessica's Law.
In 2007, our State Attorney General Roy Cooper realizes North Carolina laws are lenient on sex offenders. We are grateful for his public stance, on calling for harsher penalties and laws against sex offenders. Often, administrations have failed to make law enforcement aware of the placement of paroled sex offenders in their communities, thus allowing violent sex offenders to go freely roam our communities. By not providing mandatory hearings and stricter penalties for non-compliances, they take the power away from our law enforcers.
Taking a non-political stand various individuals, groups and organizations have formed an action group called, “Jessica’s Law Now North Carolina.” The Group formed originally in response to apathetic lawmakers, who are dithering about Jessica’s Law rather than making a solid difference toward protecting our children. This formed coalition is tired of all the prolonging games and excuses our lawmakers, have made when it comes to our children. Jessica’s Law Now worked Inco junction with Mark Lunsford and various lawmakers help see HB 933 be passed. We worked with people not a political machine.
North Carolina has many sex offenders who have fallen thought the cracks. By changing their identity and not re-registering once moved, these offenders manipulate the system.
Fatherless child is an easy target for sex offenders. Sex offenders love when a father is not around, because the child is starving for male attention.
Among girls that are 15 and younger that become pregnant, about 60 to 80 percent are by adult men. Girls between 11 and 13, who have been sexually involved with men more than five years their age, are significantly likely to attempt suicide. Today, junior high school girls are likely to become pregnant by an adult than by someone their own age.
Like other states, here are some problem areas that North Carolina still has with sex offenders.
Sex Offenders and Schools:
The job of our schools is to teach our children and provide knowledge for learning in a safe environment. Never less, one has to ask what has happened to our schools. Where a child is sexual abused by educators or children are in fear for their safety. There are many reasons, let us look at the root of the problem.
We are grateful that North Carolina’s version of Jessica’s Law requiring a background check of any company doing business with North Carolina schools has to pass a background check of their employees. Still, what about the teachers and administration they are around our children.
Until teachers and school officials are fired or force to resign because of sexual misconduct with students becomes reported to State Education Department and FBI, our schools are a Sex Offenders Playground. A Data Base should be available for all schools through a national system. This is just another reason North Carolina needs harsher and stricter laws toward sex offenders.
We of Jessica’s Law Now are endorsing U.S. Congressman Adam H. Putnam bill, "Student Proaction Act." This will put an end to our school districts throughout nation allowing sexual or physical misconduct to continue.
Charlotte - Mecklenburg Schools Superintendent Peter Gorman admitted blowing it with their background checks. Sadly, CMS has hired questionable employee's that should have never set foot around our children. Until the laws become harsher and the cracks sealed up, our children remain vulnerable.
Charlotte Observer reported Wednesday, Dec. 17, 2008, an Independence High teacher and swim coach was charged with paying two students to pose naked for photographs in his Concord home.
Michael Randolph Tye Jr., 39, who teaches psychology and human geography at the southeast Charlotte school, charged with two counts each of first-degree sexual exploitation of minor and indecent liberties with a student.
The incident, which happened involved two male Independence students, said Concord police Capt. Gary Hatley. One of the students reported it, and police found photos on Tye's camera, Hatley said.
Hatley said Tye paid the students, but he declined to reveal the amount. Concord and Charlotte-Mecklenburg police, along with CMS law enforcement, are investigating.
Tye was charged and jailed in Cabarrus County on a $100,000 secured bond. He has been suspended with pay from Charlotte-Mecklenburg Schools, spokesperson Cynthia Robbins said.
Tye has worked for CMS for 14 years, the past six at Independence. In 2000, he earned National Board Certification, a voluntary credential for experienced teachers who demonstrate their expertise. In 2006, he was named a Time Warner Cable “Star Teacher,” an honor bestowed when high-achieving students name teachers who have made a difference in their lives.
On Tuesday, a former Independence parent said she complained about Tye's after-hours activities with students at least five years ago.
As parents and citizens, we need to hold our educators responsible for our children’s welfare. Sadly enough, these behaviors have been too many and allowed throughout our school districts. The only way stop this have the Student Protection Act.
Sexual Abuse:
It started, one night his wife was gone and Jeff took pictures of me. I was in my nightshirt and he had me raise my shirt up and camera click. Then in time, Jeff would hold me so tightly I could not breathe. Jeff would be holding me and we be rolling around together. I could feel his hands and fingers between my legs. I told him did not like this but he just look at me. I did not like him putting his penis in my mouth and other places. I have lost so much to this bastard, who has ripped out my soul and tormented my body.
I am 14 years old now and have to deal with these horrible memories daily.
Many situations have occurred like this throughout North Carolina and Jessica’s Law Now is fighting help make the difference. We help steer victimized families of children with getting the help they need.
Do for a Sexually Abused Child:
1.) Ever believe that your child been sexually abused, do not be afraid to report it nor blame yourself. Report the abuse to the police immediately.
2.) You need stay calm to help your child.
3.) Provide a calm atmosphere and environment for your child.
4.) Stay with your child through each step of the investigation giving them support and encouragement.
5.) Convey that your child they are no way responsible for what they encountered. Being reassurance of encouragement and support will help your child.
6.) Have a physician see your child for an examined soon as possible. This is not only important for your child's welfare, but it will help the authority’s document evidence.
7.) Stay with your child; why the doctor is examining your child and give support with encouragement. Remember that this child has gone through a horrible ordeal and they are terrified.
8.) Request a child advocate that will help you, as well as your child.
9.) Very important, your child receives experienced counseling from a counselor that is experienced handling child abuse.
10.) Talk with the doctor that examines your child and child advocate for suggestions of somebody. Remember that both parties are familiar with the situation and will have child's best interest.
Psychological damage inflicted on a defenseless child lasts a lifetime, if they survive. Sexual predators are always looking for their next victim.
Sex Offenders and Internet:
The FBI has made it hard deal with war of child pornography. Bureau devotes just a token of agents; resources to investigate obscenity crimes are not depict extreme pornography. The FBI started in 1996 investigating the exploitation of children through the computer found sex offenders have brought out ties to all occupations.
Internet been allowed to come full of the most sick and deprave garbage showing babies, children and teenagers performing horrible sexual acts.
Various adult sites claim their pictures are legal or barely, but are they? We found a large number of these adult sites with under age boys and girls. Internet sites like these are full of spyware and Trojans that cause other problems to computer and many times, this malware infects computers files. Which leads to other crimes, such as theft of personal information, etc?
In recent research, we have found rogue sites that use code words. The disgusting photos of sexually brutalized children should haunt our lawmakers. Sadly, these codes not known always to law enforcement, because they are constantly changing and many children are suffering from official’s lack of knowledge, as well as lack of state, federal laws and funding to combat cyber-child porn.
Many of these sites connect to one another forming a network. Some of these networks have touched upon various web sites in North Carolina.
Many of the sites use celebrity user names for emails like Elvis and Carmen Electra, as well as many young girls dolled up, as being in a beauty pageant. I saw many of these so-called models fixed up to look like Jon Benet Ramsey. I am sure that members of Presley family and Carmen Electra would not appreciate their namesake being linked to child pornography nor members of the Ramsey family having Jon Benet’s image used promote child pornography.
What is sad and very upsetting, when these children are lured into this, it starts as innocent photography but the ramification to the child is what is disastrous. Lawmakers seem stick their heads in the sand, instead of making a difference.
Our advice to all parents,” Awareness is your best defense."
Our teens chat and post personal information on their computers daily. Your child could be chatting with a convicted sex offender. Unlike many cities in North Carolina, you will find a large number of sex offenders register and un-register. The FBI asks parents to monitor your children on the computer. Remember, it could just save their life!
Predators look for ways find out information out about our children. One-way, they do is through proud parents displaying images on vehicles like family image decals. It is sad that something so innocent can lead to, something as horrible as stalking, especially when it is a minor.
Predators have been able to use the internet to help select their next victim. Today, one can find anything they want, on the internet. A person can find locations of where a child lives, goes to school and personal family information too. This technology provides an open window to children that predators come into threw and prey upon our children.
What is most alarming is what known as “Street View Maps.” These maps provided by Google on the internet, allow one to find out information about ones’ home.
Google’s Street View Maps gives anyone with an Internet connection the ability to view street level pictures of any address that been captured in the Street View program’s aerial views of your home, your child’s schools, your child’s parks, and sometimes even your children playing outside. Cities as Charlotte, Durham, Winston – Salem and Raleigh, North Carolina have capability of Google's Street View Maps.
Question, what do you do about this? Will you help make a difference for a child?
We need our city, county and state leaders help put a stop with this. Please contact your city, county and state leaders and ask them make a difference by limiting Street View Maps, as well as work with law enforcement.

Sex Trafficking and North Carolina:
Question, does slavery and human trafficking exist in North Carolina?
Yes!
Human trafficking of children for sexual exploitation has made the way to our state and cities.
Like North Carolina many states have a growing problem when comes to kidnapping and selling of children. One of the major cities throughout the United States Atlanta, GA. found that the average age of victims is 14, but girls that are 11 and younger been sold.
Various dating services, escort services and strip clubs throughout North Carolina have a connection with sex trafficking. These businesses may appear legal, but are fronts for major prostitution rings. Even brothels have sprung up throughout various cities and communities in North Carolina. Several of these brothels, strip clubs and escort services been linked. These businesses have pipelines not only to each other, but also other states as well as over seas. Most of the human trafficking has been under-aged girls. Brothels have lured local girls well as run a-ways. It been estimated that North Carolina could have 80 or more brothels in parts of the state, said federal law enforcement. In a discussion with various government agencies, they stated by 2012 that trafficking of children would out do illegal arms and drugs.
Let us look at what these girls encounter in a brothel daily. First, these girls endure physical and mental abuse at all times. This places these girls in a state of constant fear, for their lives, as well as for the lives of their families. These girls are force to perform various sexual acts every 12 to 35 minutes. Any kind of sexual act be performed on demand, or the girl will encounter harsh physical consequences. We have found out that various known businesses, officials and politicians, as well as well-known people been linked to sex trafficking
Realize this North Carolina, we are a trucking through fare. What had better place to hock this trade? We need to protect those who been victimized like this. Think about it. Remember, it could be your child in this horrific position, would you not want them to receive help?
Greensboro Police have found several prostitution trafficking rings past several years. May 2004, Home Depot Security Guard saw a large number of vehicles escorting young girls into a van. This became North Carolinas largest Human Trafficking case, so far. Greensboro Police held over 20 people for various charges including prostitution trafficking. Greensboro Police have had several brothels that were on Phillips Avenue, Rainbow Street, Gurrant Street, and Freeman Mill Road. Numbers of strip clubs linked to human trafficking connections.
Winston-Salem, Raleigh, Fayetteville and Charlotte Police have encountered same situations with human trafficking of under aged girls with brothels. Our state law enforcement has found escort services and strip clubs that were prostitution rings.
Findings have shown legal authorities come up short comes to protecting our children.
United States State Departments Advisor on Trafficking stated,” We are not finding victims in the United States because we do not look for them."
A source with North Carolina law enforcement said, we cannot handle these problems of Sex Trafficking, Internet because lack of funding and work force. According to federal authorities, these adult sites are in record number and they are doing their best.
Outcome:
Each year, almost 1 million American children experience abuse and neglect. Approximately 1,400 of those children killed each year from abuse, more than three-quarters of fatalities because of abuse involve children younger than 4 years old.
Each week, child protective services agencies in the United States receive more than 50,000 reports of child abuse or neglect, and annually, nearly 900,000 of these cases substantiated. In 2006-2007, North Carolina had 111,000 children reported Abused and Neglected. Data shows children in North Carolina abused or neglected every 15 minutes and that actual sexual abuse of children 15 times greater than officially reported in North Carolina.
Presently, 10,000 registered Sex Offenders move to a new address or jobs daily. Children, women, elderly, incapacitated or handicapped people are especially at risk from sexual predators. Charlotte, Greensboro and Raleigh are no different; each city has a large number of registered sexual offenders. North Carolina has 13,900 sex offenders register and with a population of 8,227 in thousand, it comes to 1,689.6 per million. This figure does not count un-register sex offenders.
Basic Statistics:
1.) 1 in five children solicited on line.
2.) 50 thousand predators are on line.
3.) Since 1997 child pornography, sites have increase 1500 %.
4.) Web sites that exploit children are a $57 Billion Dollar Industry.
5.) 95% of children that are molested knows and trusts their molester.
6.) 90% of sex crimes are committed against someone the perpetrator knows.
7.) 20% of girls and 17% of boys are molested before their 18th birthday.
8.) Sadly, 80% of females in the porn industry been sexually abused.
9.) More than 1 million people yearly are trafficked throughout international borders against their will.
10.) Shared Hope International studies show 600,000 to 800,000 individuals are trafficked across international borders each year: 80 percent of them are women and under age girls.
11.) The C.I.A. estimates 50,000 to 100,000 girls, boys and women are trafficked annually into the United States to be pimp out or sold for forced sex. What it took for North Carolina have Jessica's Law:
With 40,000 sign petitions to date wanting Jessica's Law in North Carolina, we hope that North Carolina lawmakers will take a stand for tougher laws against child predators.
Past three years, we voiced our outraged to North Carolina lawmakers for failing to provide stricter laws against sex offenders. North Carolina General Assembly should not view children as Democratic or Republican. Please do not allow politics and compromise to get in the way of protecting our families.
North Carolina State Senator Neal Hunt has been in favor of HB 933 Jessica Lunsford Act aka. Jessica's Law. State Senator Hunt said people need to email and call their district North Carolina State Senators, and tell them support HB 933 aka. Jessica's Law.
Past three years, Jessica’s Law Now North Carolina sent over two thousand emails and over one thousand phone calls to lawmakers.
On June 11, 2008, a new harsher version of HB 933, Jessica Lunsford Act aka. Jessica’s Law has passed the N.C. Senate. This harsher version of HB 933 sent to J II Committee in the N.C. House. Various members of the J II Committee had problems with the additions that the North Carolina Senate added to HB 933.
North Carolina Representative Dan Blue, Chairman of Judiciary II Committee felt that a Sub Committee should try to work out these differences and appointed North Carolina Representative Rick Glazier as chairman.
Sub Committee met several times and had many discussions regarding the reasons for allowing sex offenders on school grounds and their rights. North Carolina Representative Jennifer Weiss was more concerned over rights of sex offenders than the victims. The Sub Committee ran into other dilemmas such as; sentencing, structure of wording in the bill and wanting to make changes to what the North Carolina House passed originally with HB 933.
Sub Committee reported to the J II Committee and they agreed to Report Unfavorable Concurrent and to Cal Pursuant Rule 36 (b). This allowed the North Carolina House to vote and HB 933 failed.
On July 7, 2008, N.C. House Appointed Bill Conferees (Committee). This group met discussed the select problems of wording and concern of various rights for sex offenders. An agreement was reached and the language changes were added.
On July 8, 2008, N.C. Senate Appointed Bill Conferees (Committee). The group received the changes and there was an understanding HB 933 completed with N.C. House by Thursday, July 10, 2008. For the next several days, a cat and mouse game occurred and HB 933 was in the middle.
For three weeks, members of Jessica's Law Now North Carolina attended every meeting and did everything we could to assist in getting HB 933 passed through the legislation. The volunteer members that stayed in Raleigh for the three weeks paid for all their personal cost.
Finally, the North Carolina House moved forward and HB 933 and a vote occurred.
Thursday, July 18, 2008 both North Carolina Senate and North Carolina House approved HB 933. North Carolina Senate unanimously voted yes to pass HB 933; the North Carolina House only had one negative vote.
"One of the proudest moments in my life was being able to call Mark Lunsford tell him the North Carolina Legislators have passed HB 933 aka. Jessica's Law," said Mark A. Palmer, Executive Director of Jessica's Law Now.
Mark Lunsford was excited and overjoyed to receive the news.
Monday, July 28, 2008, Governor Mike Easley sign HB 933 Jessica Lunsford Act of North Carolina aka. Jessica’s Law. This occurred in the Council Chamber at City Hall,181 South Street, in Gastonia, N.C. at 2:00 p.m.
Mark Lunsford made a heart felt speech and made it clear that this met a lot him, especially with the signing taking place in Jessica hometown of Gastonia, N.C. Mark Lunsford stated, “Instead of them stalking our children we are stalking them.”
Jessica’s Law Now North Carolina is very grateful for all the hard work the Representatives did from: Julia Howard, Tim Moore, Debbie Clary and Senator David W. Hoyle, Senator Tony Rand, as well as all the co-sponsors of this Bill.
One can say, North Carolina has truly honor Jessica Lunsford now.
Executive Director of Jessica's Law Now, Mr. Mark A. Palmer stated, “Over the past several years, I have given time to push for tougher laws, regarding sex crimes, especially on sexual predators. Personally, I have worked with sexually abused children and have seen the effects. Words cannot even begin to describe seeing the rape of child innocent soul. The soul becomes amputated and takes a lifetime to repair, if ever!”
Jessica’s Law Now will be continuing stand up for harsher laws and victimized children.
